HHC Ban in Spain: Order SND/380/2025 Explained

Statement following the publication of the ban on hexahydrocannabinol (HHC) and other cannabinoids in Spain

After weeks of waiting, today the Official State Gazette (BOE) has published Order SND/380/2025 of 14 April, which updates annex 1 of Royal Decree 2829/1977 of 6 October, regulating psychotropic medicinal substances and preparations and the control and inspection of their manufacture, distribution, prescription and dispensing.

This order incorporates into Spanish law several substances recently placed under international control by the United Nations Commission on Narcotic Drugs, in compliance with the 1971 Convention on Psychotropic Substances.

Among the substances included, the most notable is the addition of hexahydrocannabinol (HHC) and several of its derivatives and structural analogues to List II of annex 1, which means they are officially controlled in Spain and subject to the corresponding control measures and penalty regime under current law.

Cannabis-related substances included in List II:

  • Hexahydrocannabinol (HHC)
  • Hexahydrocannabinol acetate (HHC-O)
  • Hexahydrocannabiphorol (HHCP)
  • Hexahydrocannabiphorol acetate (HHCP-O)
  • Delta-8-tetrahydrocannabiphorol (delta-8-THCP; JWH 091)
  • Tetrahydrocannabiphorol (delta-9-THCP; THCP)
  • Tetrahydrocannabiphorol acetate (THCP-O)
  • Tetrahydrocannabinol acetate (THC-O)
  • Delta-8-tetrahydrocannabinol-C8 (delta-8-THC-C8)
  • Delta-9-tetrahydrocannabinol-C8 (delta-9-THC-C8)
  • Hydrocannabidiol (H4-CBD)
  • Tetrahydrocannabinolic acid (THCA)

The order is issued on the basis of article 149.1.16 of the Spanish Constitution, which gives the State exclusive competence over legislation on pharmaceutical products.

The inclusion of these substances means that manufacturers, importers, exporters, distributors and dispensers must adapt their activity to the regime established by Royal Decree 2829/1977 and the Order of 14 January 1981, with all the resulting obligations and controls, AND MUST IMMEDIATELY STOP DISTRIBUTING AND/OR SELLING THEM.

This order enters into force tomorrow, 23 April 2025, the day after its publication in the BOE.
