Are cannabis social clubs legal in Spain?
Setting up an association of cannabis users is legal: it is an exercise of the right of association. What is not regulated is its activity, such as growing for members or consumption on the premises. The courts have punished models that resemble organised distribution, which is why the design of the club is key.
We explain it in detail in our guide on what a cannabis association is and how it works.
How to reduce your club’s legal risk
Most problems do not come from incorporation but from day-to-day management: the number of members, admission, how the club is supplied or consumption on the premises. We review your model and give you clear guidelines. If you are just starting out, read the requirements for setting up a cannabis association.
Frequently asked questions
Your questions answered
How many members do you need to set up a cannabis association?
At least three founding members, under article 5 of Organic Law 1/2002 on the right of association.
How long does registration take?
The register has a maximum of three months to decide. On top of that you need to allow time for the municipal licence for the premises.
Do the premises of a cannabis club need a licence?
Yes. If the club has premises open to members, it needs the corresponding municipal permit. The requirements depend on each town council.
Can you defend the club in criminal proceedings?
Yes. We defend the association, its board and its members during inspections and criminal proceedings.
